Mobile Phone Driver Avoids Totting Up Ban

Another delighted client kept his licence today following a possible totting up ban after he was caught driving whilst using his mobile phone.

The 3-point offence caused this client to reach 12 points, leading to a summons to attend Leeds Magistrates Court today as he was at risk of a disqualification.

When a driver reaches 12 or more points on their licence, they face a 6 month totting up disqualification.  The only way to avoid this totting up ban is to show that you or others would suffer Exceptional Hardship if banned.

This is a scenario that we see very often at Motoring Lawyers Online, and we pride ourselves on our ability to expertly prepare these cases successfully.

Leeds Magistrates Court today found that this client would suffer Exceptional Hardship if he was to receive a totting up ban and so used their discretion to not impose a disqualification.

The client was, of course, delighted.

Be Road Aware: Speed Limits For HGV Lorries To Be Increased?

The Department for Transport have made proposals to increase the speed limit for HGV lorries, meaning vehicles over 7.5t would have their maximum speed limit for single carriage roads increased from 40mph to either 45mph or 50mph.

The proposal comes about following DfT statistics which estimate that some 70% of HGV lorries travel at above 40mph already, giving those drivers an unfair advantage over the drivers who stay within the speed limit.

It is proposed that the increase would allow over £30 million each year in benefits from faster journeys and reduced congestion.  It is also thought that it may reduce collisions caused by vehicles over-taking slow-moving HGVs.

Feared negative consequences include effects on road repairs, road safety and the environment.

I’m often asked about the details of my work; defending motorists around the country.

People are curious – do I lie to get them off?  Do I believe their versions of events?  Do I really make a difference for them?

I believe that my answer to these questions is one of the reasons why Motoring Lawyers Online has quickly grown into a large, successful company with happy clients and valued staff.

I see my role and the role of my team very clearly:

Even for cases where a client wants to plead not guilty and all of the evidence looks to be against them, my role is definite.

Firstly, I have to use my legal knowledge to be realistic with them.  I have to inform them if their case doesn’t appear to be strong (this is why my firm don’t just advise every caller to plead not guilty and run an expensive trial – as we know some firms do), and I have to make them aware of the possible consequences for being found guilty at trial.

But, after all this, I have to tell them the most important thing:

“Only you know the truth.  If you tell me you are not guilty, I believe you, and me and my team will defend you to the best of our ability.”

When I say this, I mean it.

And that’s my role.

Other people might be able to learn the law, but I know for a fact nobody cares about a client’s case as much as we do.
